2. Your statutory rights
Consumers have statutory rights in relation to the Goods. Those rights are not affected by this guarantee.
A Consumer may choose to rely on statutory rights against us as the seller instead of, or where appropriate in addition to, making a claim under this guarantee. We will not require a Consumer to use this guarantee instead of a statutory remedy.
3. Duration and territorial scope
3.1 The guarantee lasts for 25 years from the original date of supply shown on our invoice.
3.2 It applies to qualifying Goods supplied for installation in the United Kingdom, unless the Order Confirmation expressly extends the territorial scope to another country.
3.3 For an overseas project, the guarantee covers only the supplied qualifying timber components and does not include international travel, freight, customs, access or local labour unless expressly stated.
3.4 The guarantee applies to the original purchaser. It may be transferred only where we confirm the transfer in writing following a request from the purchaser or subsequent property owner.
4. Qualifying Goods and components
4.1 The guarantee applies only where the Order Confirmation states that the 25-Year Timber Guarantee is included.
4.2 Qualifying components are the structural and enclosure timber components manufactured by us from the specified Accoya or ThermoWood, including posts, rails, framing, body panels and louvres, but only to the extent identified in the project Specification.
4.3 A component supplied by another manufacturer or made from another material is not a qualifying timber component unless expressly included in writing.
5. What is covered
Subject to these terms, we guarantee qualifying timber components against:
- qualifying timber rot: fungal decay that materially compromises the structural integrity or serviceability of the qualifying timber component; and
- structural manufacturing defect: a defect in our material selection, joinery or manufacturing workmanship that causes a qualifying timber component to fail to perform its intended structural function under the agreed project conditions.
The guarantee applies only to a defect originating in the qualifying timber component or our manufacture.
6. What is not covered by the 25-year term
The 25-year term does not cover:
- clock mechanisms, dials, hands, controllers, batteries, wiring, lighting or electrical equipment;
- weathervanes, finials, lettering, crests or decorative metalwork;
- paint or coating appearance, gloss, colour fade, chalking, sealants or routine touch-up;
- lead, copper, fibreglass, roof membranes or other non-timber roof materials;
- fixings, supports, curbs, frames, flashings, roof coverings or waterproofing supplied or installed by others;
- the receiving building, roof structure, foundations or services;
- surface dirt, algae, mould that has not caused qualifying decay, natural grain variation, minor checking, normal movement or cosmetic weathering;
- dents, scratches, impact damage, theft, vandalism or animal damage;
- damage caused by fire, flood, lightning, exceptional storm, falling objects, collision, pollution or another external event;
- damage caused by an undisclosed marine, coastal, chemically aggressive or unusually exposed environment where a different specification would reasonably have been required;
- damage caused by incorrect storage, lifting, installation, inadequate support, building movement, water ingress from the receiving roof, blocked drainage or ventilation, unauthorised alteration, misuse or neglect; or
- loss of use, loss of income, scaffolding, craneage, roof work, decoration or other consequential cost, except where recoverable under statutory rights or expressly included.
An exclusion applies only to the extent that the excluded event caused or materially contributed to the claimed defect.
7. Separate warranties
Clock equipment and bought-in components may carry a manufacturer’s warranty stated in the Quotation.
Coatings, roof materials, installation and other items may have separate workmanship or product warranty periods stated in the Contract.
Those warranties are separate from this 25-year timber guarantee and do not reduce Consumer statutory rights.
8. Installation conditions
The tower must be:
- installed by competent persons;
- supported in accordance with the project information and any required structural design;
- lifted and fixed using approved methods;
- integrated into the receiving roof using suitable weathering and waterproofing details;
- provided with the specified ventilation, drainage and service access; and
- electrically connected by a competent person where applicable.
Incorrect installation does not automatically invalidate the whole guarantee. However, we are not responsible under this guarantee for a defect to the extent it was caused or materially worsened by incorrect installation.
9. Inspection and reasonable care
9.1 Carry out a visual inspection at least once in every 12-month period and after severe weather, impact or nearby building work.
9.2 Check for damage to coating, open joints, blocked drainage or ventilation, water staining, movement, loose external fittings and defects in surrounding roof work.
9.3 Repair accidental coating damage promptly using a compatible system and deal promptly with water ingress or movement originating outside the supplied turret.
9.4 Keep dated photographs and records of inspections, servicing and repairs.
9.5 Failure to keep a record is not by itself an automatic reason to reject a claim where the condition and cause can otherwise be established. We may reject or reduce a commercial guarantee claim only to the extent that failure to inspect, notify or repair caused or materially worsened the problem.
10. Alterations and repairs
Do not cut, drill, dismantle, attach equipment to or materially alter a qualifying component without written approval.
Emergency work needed to protect people or property may be completed without prior approval, but you should photograph the condition and contact us as soon as reasonably possible.
A repair by another contractor does not automatically end the guarantee, but we are not responsible for defects caused by that repair or for costs not authorised in advance, except where the law requires otherwise.
11. Making a claim
Notify us in writing as soon as reasonably possible after discovering a potential defect.
Send the claim to enquiries@bespoketowerclocks.co.uk and include:
- purchaser’s name and current contact details;
- original order or invoice number;
- Site address and installation date;
- clear photographs and, where useful, video;
- a description of when the issue was first noticed;
- installation details and the installer’s identity;
- inspection, maintenance and repair records reasonably available; and
- details of any event that may have caused the damage.
Do not remove or dispose of the affected component before we have had a reasonable opportunity to inspect it, unless urgent action is needed for safety or to prevent serious damage.
12. Inspection of a claim
We may request further photographs, an independent report or safe access to inspect the tower.
The owner is responsible for providing lawful and safe access in the first instance. If the claim is accepted under statutory rights, responsibility for reasonable access costs will be determined by those rights. Under this free commercial guarantee alone, scaffolding, craneage and access equipment are not included unless we agree otherwise in writing.
If an inspection shows that the issue is not covered, we may charge a reasonable pre-agreed inspection or travel cost, but not where doing so would be unfair or contrary to Consumer law.
13. Our remedy
If we accept a valid claim, we will, within a reasonable time and at our choice:
- repair the affected qualifying timber component;
- supply a replacement component;
- replace the qualifying turret structure; or
- agree another remedy of equivalent practical value.
The chosen remedy will take account of safety, proportionality, access, product age and whether a repair can provide a durable result.
Replacement may use the nearest reasonably available equivalent material, profile, colour or component where the original is no longer available, but any material visible change will be discussed first.
A repaired or replacement component remains covered for the balance of the original 25-year period; the guarantee does not restart.
14. Costs included and excluded
For a valid claim under this commercial guarantee, we cover the reasonable cost of the qualifying replacement component and our workshop labour required for the chosen remedy.
Unless expressly agreed, this commercial guarantee does not include:
- scaffolding, craneage, hoists or special access;
- removal and reinstallation by others;
- opening or reinstating the receiving roof;
- decoration or making good outside the supplied turret;
- travel and accommodation outside our normal UK service area;
- international freight, customs or local labour; or
- losses caused by business interruption or loss of use.
These exclusions do not limit any separate amount recoverable under mandatory statutory rights.
15. Ownership changes
A request to transfer the guarantee should be made within 90 days of a property sale and include the original order details, new owner’s contact information and current condition photographs.
We may require a reasonable inspection before approving transfer and may charge an agreed inspection or administration fee. Approval will not be unreasonably withheld where the product has been correctly installed and reasonably cared for.
16. How to obtain a durable copy
A copy of this guarantee will be supplied with the Order Confirmation or handover information by email or another durable medium. A replacement copy is available on request.
17. Governing law
This guarantee is governed by the law of England and Wales, subject to mandatory Consumer rights and jurisdiction rules that apply where the Consumer lives.
